Proposed Clarification on Fixed
Duration Contract Law: Potential Impacts
on Employers and Businesses in Cambodia

Diverging and contradictory interpretations and practice of employment contract provisions have caused tension to the relations, and often time disputes, between employers and employees, including those in labor intensive industries. To bring the issue to rest, a proposal has been introduced by the Ministry of Labor, in consultation with CAMFEBA and trade unions, to clarify the employment contract provisions through a Ministerial regulation called “Prakas on Determination of Fixed Duration Contracts”. Although still under discussion, if adopted in its present form, the Ministerial regulation would present new challenges with regard to the hiring and firing of employees/workers that would span across not only the labor intensive industries but also the rest of the business sectors. It is therefore essential that employers and businesses get up to date about and prepared for the forthcoming Ministerial regulation. |
